Terms and Conditions of Service

JJM Online Designs
Last updated: September 2026

These Terms and Conditions govern all bespoke digital design commissions, vehicle livery services, textures, and graphic assets supplied by JJM Online Designs ("the Designer", "we", "us") to the client ("you", "customer"). By submitting an order brief, paying an invoice, or instructing work to commence, you agree to be bound by these terms.

1. Trader & Business Information

  • Trading Name: JJM Online Designs
  • Contact Email: [email protected]
  • Geographical Location: United Kingdom (Full postal address supplied upon request or on formal invoices in accordance with UK consumer regulations).
  • Core Service: Creation of custom digital graphics, gaming vehicle liveries, texture maps, and bespoke visual assets.

2. Ordering & Contract Formation

  • Brief & Quotation: Orders initiate via a brief submitted through our website, email, or official communication channels (e.g., Discord). We will issue a price quote and delivery estimate.
  • Contract Formation: A legally binding contract is formed once you accept the quotation and submit the required upfront payment or agreed deposit.
  • Brief Accuracy: You are solely responsible for ensuring that all specifications, dimensions, template requirements, reference files, and text/spelling supplied to us are accurate before work begins.

3. Statutory Right to Cancel & Express Waiver (UK Consumer Regulations)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers generally hold a 14-day statutory cancellation right. However, our services involve bespoke, made-to-order digital content and creative services:

  • Express Request to Commence: By placing an order and paying the required invoice/deposit, you expressly request that the performance of the bespoke service begins immediately within the statutory 14-day cancellation window.
  • Waiver of Cancellation Rights: You acknowledge that once your order status is marked as "In Design Process" (creative work has begun), you lose the statutory right to cancel or claim an automatic refund.
  • Cancellations Prior to Commencement: If you cancel an order before work is marked as "In Design Process", you will receive a refund minus any unrecoverable payment processing fees incurred through the transaction provider.

4. Revisions, Acceptance & Refunds

  • Revision Limits: Draft proofs or screenshots (watermarked) will be shared for your review. Your quote includes up to two (2) rounds of minor revisions within the scope of the original brief. Revisions requested beyond this limit, or changes departing from the original brief, will incur supplementary design fees.
  • Client Communication & Inactivity: If a client fails to respond to draft submissions, revision queries, or messages for more than 30 consecutive calendar days, the commission will be deemed accepted and closed. Any resumption after this period may require a reactivation fee.
  • Final Acceptance: Once un-watermarked, high-resolution final assets are delivered (via download link, email, or direct file transfer), the service is deemed complete and accepted.
  • Refund Policy: Once final assets have been delivered, no refunds are granted. Under the Consumer Rights Act 2015, if a delivered file is corrupted, non-functional, or fundamentally fails to match the agreed specification, we will repair or replace the file at no additional cost. We do not provide refunds or free replacements for issues arising from third-party platform updates, game model mismatches, or user software incompatibility.
  • Discretionary Partial Refunds: Any refund requested while an order is "In Design Process" remains entirely at the Designer’s discretion and will be pro-rated to account for hours, labour, and creative drafts already completed.

5. Delivery & Performance

  • Digital Delivery Only: All deliverables are transmitted digitally via direct download, cloud links, or messaging transfers. No physical products are shipped.
  • Timeframes: We aim to deliver within the target timeframe provided in your quote. If delays arise due to workload or unforeseen circumstances, you will be notified promptly. Unless a longer project window was expressly agreed in writing, final assets will be supplied within 30 days of contract formation.

6. Pricing, Payments & Chargebacks

  • Base Currency & Localized Display: Our core accounting currency is British Pounds (£ / GBP). Where supported, checkout displays and processes payments in your local currency via automated processor localization (Stripe Adaptive Pricing).
  • Exchange Rates: Localized checkout totals reflect live mid-market exchange rates and standard processor conversion rates. Any secondary international transaction fees imposed directly by your issuing bank remain your responsibility.
  • Taxes & VAT: Displayed prices at final checkout represent the total payable amount. JJM Online Designs is a UK-based micro-enterprise and is not currently VAT-registered; therefore, UK VAT is neither charged nor itemized.
  • Payment Terms: Payment must be settled in full (or as an agreed upfront milestone deposit) via supported methods (Stripe, debit/credit card, Apple Pay, Google Pay) before work enters "In Design Process" and before un-watermarked files are released.
  • Disputes & Chargebacks: Initiating an unwarranted payment dispute or chargeback without prior communication constitutes a breach of contract. Doing so will immediately terminate all usage licenses for delivered assets and result in blacklisting from future commissions.

7. Intellectual Property & Commercial Usage

  • Client Materials: You warrant that all logos, trademarks, insignias, or graphics supplied to us for inclusion in your design do not violate third-party intellectual property rights. You agree to indemnify the Designer against claims arising from assets provided by you.
  • Delivered License: Upon full payment and asset delivery, you are granted a worldwide, non-exclusive, perpetual license to use the final design asset for its agreed personal or organizational purpose (e.g., community server fleet, personal gaming, video production).
  • Restrictions: You may not claim the underlying artwork as your own, resell, redistribute, sub-license, or share the raw, editable project files/textures to public asset hubs or third parties without prior written consent.
  • Portfolio Rights: The Designer retains the right to display watermarked captures, previews, and 3D renders of the completed livery across personal portfolios, social media, and promotional material, unless an explicit Non-Disclosure Agreement (NDA) was executed before work started.

8. Third-Party Platforms & Compatibility

  • Our liveries and textures are crafted to match standard community templates and specifications agreed upon during the brief.
  • JJM Online Designs is not affiliated with, endorsed by, or responsible for updates, changes, or bans imposed by third-party game platforms, mod engines, or community frameworks (such as Roblox, Emergency Response: Liberty County, FiveM, Microsoft Flight Simulator, or Discord).

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute or claim arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
